SMS/TEXT MESSAGING TERMS AND CONDITIONS

These SMS/Text Messaging Terms and Conditions (“SMS Terms”) apply to the non-marketing text-messaging program offered by Sweeney Law Firm, P.C. (“Firm”). They supplement the Firm’s engagement agreement and other applicable terms. If there is a conflict concerning legal representation, the signed engagement agreement controls.
1. Program Description
The Firm may send SMS/MMS messages concerning an inquiry or legal matter, including appointment reminders, case or court updates, requests for documents or information, filing or payment reminders, office notices, and responses to requests. The program is not intended for advertising or promotional messages.
2. Consent and Eligibility
By enrolling, you confirm that you are the subscriber or customary user of the mobile number provided, are authorized to consent, and agree that the Firm and vendors acting on its behalf may send texts using automated technology. Consent is not a condition of purchasing or receiving legal services or representation. You must notify the Firm promptly if the number is reassigned, disconnected, or no longer yours.
3. Message Frequency and Charges
Message frequency varies based on the needs and activity of the matter. Message and data rates may apply. Contact your wireless carrier for plan details.
4. Opt-Out and Revocation
Reply STOP to a Firm text to opt out. The Firm will also honor any other reasonable method that clearly communicates a request to stop automated texts, including a request made by telephone, email, or letter to the contact information below. The Firm may send one non-marketing text confirming the opt-out. Allow a reasonable processing period, not longer than permitted by applicable law. After opting out, call or email the Firm for communications. An opt-out from texts does not end an attorney-client relationship, change obligations under an engagement agreement, or excuse compliance with deadlines.

6. Delivery and Carrier Disclaimer
Text delivery is not guaranteed and may be delayed, filtered, or unavailable. Wireless carriers are not liable for delayed or undelivered messages. The Firm is not responsible for consequences caused by a carrier, device, network, or service interruption outside the Firm’s reasonable control.
7. Confidentiality, Security, and Urgent Matters
SMS/MMS may not be secure. Do not send Social Security numbers, full financial-account numbers, passwords, medical records, or other highly sensitive information unless the Firm provides a secure method. Do not rely on text messaging for emergencies, urgent instructions, service of legal papers, or satisfaction of a court or statutory deadline. Call the Firm and obtain confirmation for time-sensitive matters. The Firm cannot guarantee that a text will be reviewed immediately.
8. No Attorney-Client Relationship or Legal Advice by Website/Text Alone
Submitting a form or sending or receiving a text does not by itself create an attorney-client relationship. Representation begins only as stated in a signed engagement agreement or other express written confirmation by the Firm. General website or automated text content is not legal advice.
9. Privacy
The Firm handles information as described in its Privacy Policy at [PRIVACY POLICY URL]. Mobile information and SMS opt-in data and consent are not sold or shared with third parties or affiliates for their own marketing or promotional purposes. They may be disclosed to service providers supporting the Firm’s messaging program and as otherwise described in the Privacy Policy.
10. Changes and Termination
The Firm may modify or discontinue the text program or these SMS Terms. Updated terms will be posted with a revised date, and notice will be provided when required by law. Continued participation after an effective update constitutes acceptance to the extent permitted by law.
11. Governing Terms
These SMS Terms are governed by applicable federal law and the law specified in the Firm’s engagement agreement. Nothing in these SMS Terms limits duties imposed by professional-conduct rules or other nonwaivable law.
